The 2014 Pardon
On January 19, 2025, the outgoing president granted Anthony Fauci a full and unconditional pardon for any federal offenses committed from January 1, 2014 onward. The start date — not the pardon itself — is the question of this chapter.
The record shows what 2014 held: a grant, a funding pause, and the first moves in a definitional fight that ran for a decade. It also shows the same start date on more than seven other preemptive pardons issued the same day. Both readings are set out below, each with the evidence it rests on.

NIAID awards EcoHealth grant R01AI110964 (WIV subaward)
Understanding the Risk of Bat Coronavirus Emergence (PI Peter Daszak). OIG later documented WIV subaward totaling $598,611 (2014–2019). Competing renewal awarded 2019 under Trump administration.

White House / NIH gain-of-function funding pause
OSTP announced a deliberative process and pause on new federal funding for GoF studies anticipated to enhance pathogenicity or transmissibility among mammals (influenza, MERS, SARS).

NIAID reviews grant against GoF pause — determines not subject
NIAID initially flagged possible GoF; EcoHealth responded with stop-and-report benchmark for >1 log enhanced growth. NIH concluded grant was not subject to the pause and did not refer for P3CO after 2017.

NIH terminates EcoHealth grant (later reinstated/suspended)
After White House pressure, NIH terminated R01AI110964 'for convenience.' OIG later found termination procedurally improper. July 2020 reinstatement with immediate suspension and record demands; WIV subaward later terminated for non-compliance.

First gain-of-function confrontation — flat denial
Paul pressed NIH funding of WIV GoF via EcoHealth/Baric–Shi collaboration. Fauci denied NIH ever funded GoF at WIV. Paul later accused parsing of words; Ebright called the denial demonstrably false under 2014 definition.

Paul files first criminal referral to DOJ (§ 1001)
After July 20 hearing clash ('you do not know what you are talking about' / mutual lying accusations), Paul referred Fauci to AG Garland for alleged false statements to Congress on May 11.

Tabak letter — delayed reporting of enhanced growth experiment
NIH Principal Deputy Director Lawrence Tabak informed Congress EcoHealth failed to immediately report a chimeric virus with >1 log increased growth in humanized mice. NIH still maintained research was not ePPP/GoF under its definition and viruses were distant from SARS-CoV-2.

HHS suspends, then debars the Wuhan Institute of Virology
HHS Action Referral Memorandum suspends WIV and proposes debarment effective July 17, 2023; WIV formally debarred Sept. 19, 2023. The memo walks the full grant file — the May 27, 2014 award, the 2016 stop-and-report terms, the April 2020 termination — and cites WIV's failure to produce lab notebooks and biosafety protocols.

Tabak testifies at 'Overseeing the Overseers' hearing on EcoHealth grant oversight
One day after HHS announced suspension and proposed debarment of EcoHealth Alliance, NIH Principal Deputy Director Lawrence Tabak testified under oath that NIH's forensic audit found no system lockout that would have prevented EcoHealth's on-time Year-5 report (contradicting Daszak's testimony), that NIH never received the requested WIV lab notebooks or metadata, and that increased viral growth 'does not necessarily mean increased pathogenicity.' He reiterated NIH's position that grant-studied viruses were too evolutionarily distant to be SARS-CoV-2's progenitor and that the funded work was not gain-of-function under the regulatory definition.

HHS formally debars EcoHealth Alliance and Peter Daszak (5 years)
Based on Select Subcommittee evidence: facilitated GoF research in Wuhan without proper oversight and violated NIH grant requirements. Daszak employment terminated effective Jan. 6, 2025.

Biden issues preemptive full pardon of Fauci
Full and unconditional pardon for any federal offenses from Jan 1, 2014 through pardon date related to NIAID / Task Force / Chief Medical Advisor service. Fauci: committed no crime; White House approached him. Paul: pardon 'seals the deal' on responsibility narrative. The warrant covers 'any offenses... during the period from January 1, 2014' — the same start date used across more than seven other Biden preemptive pardons (Milley, Jan. 6 committee figures, family members, Hunter). Critics read the date as bracketing the May–June 2014 EcoHealth/WIV grant and the October 2014 gain-of-function funding pause; the alternative reading is drafting convention, and no primary source resolves intent.

17 state AGs seek state-law paths around the pardon
SC Attorney General Wilson leads a 17-state letter to Johnson and Thune calling the pardon 'a shameful attempt to prevent accountability' and urging Congress to refer findings for possible state-law violations a federal pardon cannot reach.

HSGAC hearing: Testimony of Anthony Fauci
Sworn testimony as sole witness before HSGAC, ~3 hours. In his opening statement Fauci announced he would invoke the Fifth Amendment, citing members' public pledges to prosecute him and the release of his diary; he then declined substantially all questions on advice of counsel. The chairman read the pardon warrant's text — including its January 1, 2014 start date — into the record and asked whether Fauci had refused or sought the pardon; Fauci declined to answer. His attorney David Schertler was removed from the hearing room at Chairman Paul's direction. Gavel-to-gavel recording and full transcript are hosted in the media library; GPO transcript pending.
Critic position
The Jan. 1, 2014 start date brackets the May–June 2014 EcoHealth/WIV grant and the October 2014 gain-of-function funding pause — read as evidence the pardon was tailored to pre-empt exactly the conduct under investigation.
